Court to Reconsider Decision That Permitted Trump to Send Troops to Oregon City
The federal appeals court has upheld a prohibition on deploying state troops in Portland, Oregon, following a latest legal decision.
Judicial Panel Concurs to Rehear Case
The ninth circuit court of appeals decided on this week that it would reexamine the case concerning the executive power with an expanded group of 11 judges. The judicial body also overturned a previous decision from a smaller judicial group that had sided with the federal government.
Legal Saga Over Military Presence
This legal directive represents the latest development in a protracted court case over whether the former president has the legal right and valid reason to deploy state military units in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in response to ongoing demonstrations.
Conflicting Arguments
The administration has claimed that government employees at the immigration center in the southern part of the city were under attack, while local authorities assert that local officers have control of the circumstances.
Contrary to characterizations of Portland as a conflict zone, locals have been posting footage of lush hiking trails and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.
Recent Legal Actions
The Tuesday ruling came after a US district judge in the city issued two legal injunctions this month – one preventing the federalization of the state troops, and another stopping the deployment of any military personnel in Oregon, after efforts to evade the initial injunction by mobilizing troops from California.
On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the second ruling stayed effective, preventing the actual deployment of the forces.

The Tuesday decision means the matter will be heard by the full court – with all decisions under review together – by a panel of eleven justices.
“This ruling shows that facts are important and that the courts are striving to ensure government responsibility. The constitution restricts the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.
“The judicial body is sending a clear message: the president cannot send the military into American urban areas without cause. We will continue defending Oregon’s laws, principles, and sovereignty as this case moves forward and our fight continues in the courts.”
